Within an hour an appeals judge put a 1 week stay on the ruling. Fucking corrupt judges

[–] bold_atlas@lemmy.world 16 points 1 day ago (1 children)

The legal system in which the poor languish in jail for years awaiting trial moves extremely quickly when it wants to.

[–] QueenHawlSera@sh.itjust.works 2 points 20 hours ago

The system is not broken, it's working as intended, and thus must be destroyed.

[–] drislands@lemmy.world 5 points 1 day ago (1 children)

Are you saying that's happened? Or that you expect it will?

[–] thepenismightier@lemm.ee 5 points 1 day ago (1 children)

Read the article it's literally in the first sentence.

[–] drislands@lemmy.world 1 points 1 day ago

God fucking dammit

[–] QueenHawlSera@sh.itjust.works 23 points 1 day ago (3 children)

Awesome, so... I don't expect him to be arrested or impeached, or for there to even be an investigation or anything.

I'm hoping for something more realistic like taking away his screen time for the weekend, or at least till he says he's sowwy.

[–] chiliedogg@lemmy.world 1 points 1 day ago (1 children)

He'd never get his screen time back in that case.

He will never, ever apologize for anything he does.

[–] QueenHawlSera@sh.itjust.works 2 points 20 hours ago

Really? I figure he'd give one of those patented "I'm sorry... That you're an offended little liberal snowflake who totally sucks!" style apologies and it'd be accepted as if it were genuine.

[–] AA5B@lemmy.world 2 points 1 day ago

Such an optimist. I’m hoping for a clear declaration of illegality so the guardsmen involved have no excuses for knowing it’s an illegal order. I hope it will support any with the courage to stand up for the law, and will dissuade any cowards with the expectation they will face jail time

[–] Buske@lemmy.world 2 points 1 day ago

He doesn't get arrested, but we do. He wont be in prison, but we are.

[–] RampantParanoia2365@lemmy.world 60 points 2 days ago (1 children)

Oh ok, cool. So naturally he's been or will soon be placed under arrest, because that's how being illegal works.

[–] blackstampede@sh.itjust.works 14 points 2 days ago (1 children)

Not anymore, it's not. He's immune from any sort of prosecution related to the job.

That means all those troops were following illegal orders.

[–] But_my_mom_says_im_cool@lemmy.world 69 points 2 days ago (1 children)

Exactly, stop going after trump. Go after every officer and government agents who followed those orders. See how fast they enforce his bullshit when they’re facing personal consequences

[–] GuyFawkes@midwest.social 20 points 2 days ago (4 children)

Can’t that asshole just pardon them though?

[–] Corn@lemmy.ml 7 points 1 day ago

Not on state charges. But Newsom doesn want the optics of going after the troops for illegally kicking the shit out of his own constituants, because that would play terribly with the only important demographic for democrats, republican voters.

[–] jballs@sh.itjust.works 24 points 2 days ago (1 children)

Yeah, but maybe Trump issuing illegal orders to the military and offering pardons to those that follow them would be the catalyst Congress needs to pass an amendment limiting presidential pardon power.

Maybe someday we'll honor the 14th amendment, nullifying 47th's term, rendering all of his pardons void

You know, since enemies of the US cannot hold office

[–] WizardofFrobozz@lemmy.ca 2 points 1 day ago (1 children)

Maybe someday you’ll honor the 2nd Amendment.

[–] morphballganon@lemmy.world 1 points 1 day ago

I've got no problem with the people bearing arms so they may rise up against a tryannical government... like one that has masked goons kidnapping farm workers and meat packers.

But the the military say they don't follow illegal orders. What's an illegal order? Well they don't really know but they definitely don't follow them!

[–] bdjukeemgood@lemm.ee 28 points 2 days ago

Lock them all up. Pure evil. Orders should always be considered against the interpretation of law.

[–] SunshineJogger@feddit.org 69 points 2 days ago (1 children)

The past year doesn't give me the feeling that this will change anything.

Trump is still free and doing his dumbevil stuff

[–] Melvin_Ferd@lemmy.world 22 points 2 days ago* (last edited 2 days ago) (2 children)

Need more Democrats to sit and wave cardboard signs. Need more protests to run head first into riot shields. Need more leftist to leave social media spaces wide open. Need more Faygo.

Then maybe things will be different

Wouldn’t it be nice if rulings against the talibangelical dictatorship actually carried any weight anymore?

[–] DanVctr@sh.itjust.works 7 points 1 day ago

Y'all Qaeda at it again

[–] Zachariah@lemmy.world 119 points 2 days ago (1 children)

A federal judge has ruled that President Donald Trump acted illegally in deploying the National Guard to address protests in the Los Angeles area.

In a ruling issued Thursday evening, U.S. District Judge Charles Breyer wrote that such use of the National Guard was a violation of the Tenth Amendment to the Constitution and exceeded the statutory authority granted to the president.

The order, which takes effect Friday, says the administration must return control of the California National Guard to the state of California.

[–] wise_pancake@lemmy.ca 50 points 2 days ago (3 children)

Doesn’t he have immunity now?

[–] Archangel1313@lemmy.ca 65 points 2 days ago (3 children)

They may not be able to prosecute him, but they can make him stop what he's doing. Theoretically.

[–] Yondoza@sh.itjust.works 15 points 2 days ago (1 children)

It does seem the power of the judiciary will be challenged quite soon.

It will probably be with a tweet saying "Make me. You and what army?" and the courts will need to rely on the US military choosing the Constitution over the Commander in Chief.

May we all have the fortune to live securely in less interesting times. I suppose it is our duty to make that happen.

[–] M0oP0o@mander.xyz 4 points 1 day ago

It does seem the power of the judiciary will be challenged quite soon.

I think that happened some time ago.

He does, but anyone following illegal orders doesn’t. Sure, he could pardon them, but only after a long, expensive, and potentially life-changing legal battle after which they’re convicted.

That doesn’t sound like a fight most regular troops should want to gamble on.

Might be true, but since the orders are illegal, the NG are following illegal orders if they continue, meaning potential court martial (depending on many factors).

[–] null_dot@lemmy.dbzer0.com 85 points 2 days ago (6 children)

The legal system is just not equipped to deal with the threat implied by Trump.

In the US it seems like judges are just another executive arm of the government anyway.

The few actual judges still considering the law just get perpetually paused with appeals and what have you.

The National Guard should release all arrested protesters, return to base and tell the Governor of California that they are "reporting for duty". If not, they are traitors (already before but then even more so).

[–] Archangel1313@lemmy.ca 27 points 2 days ago (4 children)

So...just let him keep breaking the law until it reaches the Supreme Court? I thought they were supposed to pause his actions, pending appeal...not let him keep going.

He will just ignore it, and double down. Nothing will happen.

[–] Venus_Ziegenfalle@feddit.org 36 points 2 days ago (1 children)

Nothing will happen.

The judge might get fired.

".......yeah? And?"

And nothing happened.

Don't worry, Chuck Schumer will lower his glasses a little and give Trump a stern look from across town.
