Hello everyone,

HOA will have meeting very soon in two weeks or less to vote on passing budget ratification to modernise elevator that will cost 600k, the current elevator since 1949 is not up to code and sometimes you can get locked in , we truly need new elevator, but what has been offered to us was only one company bid, as home owner I like to see more than one option, it’s free market.

HOA passed motion to go with final vote coming up in October, there are 47 units in the building and based on your condo size you’ll certain amount as percentage overall of 600k, my condo will total above 10k and others for 15k and some even for 20k , the sad thing it seems HOA doesn’t have reserve funds all these years enough to cover, in fact it only have 100k as reserve funds while HOA duties have been collected for very long time.

This special assessment will make people suffer financially, it’ll increase rent on tenants, and it’ll make really hard to sell your condo.

We have sent letters all units in the building urging them to show up on the meeting and vote no, if we don’t have 51% 25 owners says no then special assessment will be approved, HOA is willing to put payment plan limited only to one year which could $1,000 every month, some others $1500. Which is a lot considering my duties $536 for 1bd/ba while others 2bd/ba $800+ dues monthly!

Can HOA put foreclosure on your condo if you don’t pay? Why is that even legal? It sounds like class discrimination only rich people can afford to live there! What about diversity? I’ve seen black families had to leave they can’t keep paying this uprising cost! HOA can be better in management and have bigger reserve funds! HOA can collect data on what people feel comfortable paying for big projects and from there you call it a budget and then you can go find vendors who can work with these numbers

Elevator cost seems ridiculously expensive, new home owners came and got this is absolutely a nightmare for them. I’m in need of an advice.

I would like a pool but a pool requires a fence and the hoa rules state no fences. It says nothing about pools. Anyway around this or I should move/give up on the pool dream? Thanks!

I have a dog, and the HOA has imposed a rule that dogs are not allowed to be walked on the sidewalk or anywhere on the property, but are only allowed to be walked on the very narrow driveway where there are cars. It's caused near accidents for my dog and I, with the passing cars on the extremely narrow driveway which can scare my dog.

The HOA claims the community is "pet friendly" and allows both dogs and cats, and says so in the CC&Rs which I looked over before buying this home. This rule was created by the HOA shortly after I bought, and we owners never have been allowed to vote on this or any CC&Rs rule changes, as the board says they have the right to impose and enact any rule changes to the CC&Rs that they want whenever they want on a whim.

All other dog owners are scared of the authoritarian HOA and just comply with this, and the HOA has singled out me and other dog owners with bs complaints because we have dogs, even though dogs are allowed. This is the most dog unfriendly HOA I've lived in. The main reason why I chose this complex was because they claimed it was "pet friendly" and that dogs are allowed.

Oh and btw the HOA Board President has a dog, and he thinks he's above the rules, so he walks his dog on the sidewalks of the complex while all of us peasants can only walk our dogs on the driveway.

I have tried to fight the HOA on this, saying that it's dangerous to force us to walk our dogs on the narrow driveway with cars passing by, instead of being able to do the sensible safe thing and walk our dogs on the sidewalks. Their response? They claim that most of us dog owners are "irresponsible" with poop pick up so that's why we're forced to be second class citizens unable to walk our dogs anywhere on the complex except for the driveway just because we have dogs.

What recourse can I take when other residents are too chicken shit to face the HOA?

So the other day I put up a post about looking for a fence contractor that I'm considering about my yard and the President of the POA jumps on the post and says I have to get approval from the architectural committee before I install it.

Well no shit Sherlock. I'm just looking at it right now. When the time comes I'll follow the 'rules' that you don't enforce anyway unless it suits you at the time. Sheesh...

In Texas they recently (past few years) passed legislation that made the HOA more transparent. I currently live in a condominium community and the management company has told me that the news laws are not applicable in our situation. Is this true?

1. Put an end to HOA fines, foreclosures, and rule-making authority. First and foremost, state lawmakers should withdraw and prohibit power of HOA boards to fine, foreclose liens, and make rules and regulations without consent of owners. This one reform would prevent the majority of HOA problems.

2. Change voting and election process to ensure integrity. A good starting point for lawmakers: Limit the number/percentage of voting interests that can be held by any one member of the HOA.

3. Eliminate Declarant (developer/investor) control of communities. It’s extremely difficult to hold a developer accountable for poor quality construction of homes and community infrastructure. Developers retain near absolute control on the purse strings. (They can either keep HOA fees artificially low or raise them as high as they want.) A developer can — and often does — amend the CC&Rs (Covenants and Restrictions) multiple times, at will.

4. Eliminate HOA regulation of privately owned property. It’s one thing to establish HOAs to fund and govern common property. It’s quite another thing to allow HOAs to govern privately owned property. For example, what is the purpose of having an HOA overlord to compel owners and residents to get approval for landscaping design? Is it really necessary to require HOA approval of exterior paint colors, or home improvements that don’t require a local building permit?

5. Mandate HOA transparency and assist homeowners in enforcing it. Homeowners are obligated by law to pay fees to their HOA. Therefore they ought to have the absolute right to know how the HOA spends their money. But even though many state laws require HOAs to provide access to financial records upon request of any member, HOAs frequently delay or avoid doing so.

Conclusion: State legislators must look at the Big Picture when it comes to HOA regulation. Lawmakers need to revoke excessive powers of HOAs before they attempt to enforce HOAs to govern and manage the community with transparency. As long as HOAs can penalize and intimidate owners with no recourse for owners, HOAs will continue to stonewall homeowners and prolong conflicts with litigation."

We live in a townhouse community, which has changed management companies about 3-4 times over the past 5 years. The townhomes themselves are pretty old. According to the HOA, we are responsible for everything INSIDE the home and they are responsible for everything OUTSIDE the home. This includes lawn maintenance, roof repairs/replacement, siding issues, overgrown trees/limbs, gutter cleaning etc etc.

The roofs we have currently should have been replaces about 10 years ago and they are just now getting to it. Most of the units now have mold behind the siding or on the ceiling etc. We had a meeting about the roofs and there are some buildings which are considerably worse, so they are starting with those buildings. Here is the thing. The HOA mishandled the dues and cannot afford to replace the roofs on the 15 units that need to be replaced the most. Their solutions are either to take out a business loan to pay for all the roofs on this section, stretch the project off and replace one roof every 6 months, or charge every household $2,400 upfront.

I think the business loan might be the best option, but they won't tell us what affect that will have on each household. I think it will most likely increase our dues, but who knows how much.

This situation is 100% the HOA's fault for not handling our dues correctly, but since the community has changed management companies so many times, they told us they cannot find a paper trail to explain what are dues went to instead.

Our community is about 100 units each pay $240 in dues every month.

Is there any sort of action that we can take?

Fuck an HOA. I can't wait until we can move.

Trying to figure out if there's anything we can do in this situation.

The CCRs, written in 2000, do state that all cars, including guests, must be parked in driveway or in the backyard out of sight. There aren't any no parking signs outside our home except a paper taped to a light pole that I never noticed until trying to look for a sign after this happened.

We park our two cars in the drive way. Several of our neighbors have more than two cars and park on the streets constantly.

Last night my moms friend came over to pick her up. She arrived around 7:30, and when they went to leave shortly after 8 her car had been towed for parking in a no parking zone, while many of our neighbors still had cars on the street.

Is this just insane bad luck? Do we just need to pay the $300 to get her car back and not have guests over anymore? We have a guest parking area down the street, but it requires purchasing a permit (which we've never been instructed on how to do) and this friend is disabled, so walking over a block to and from her car is just too much.

We're extra bitter right now because there's been a car parked, in the same exact spot she was, in front of our house for 7-8 hours now.

Owners of condominiums at The Renaissance on Turtle Creek in Oak Lawn and the building’s COA board have been embroiled in conflict all summer since the board bid millions of dollars on a neighboring property in July without many owners’ knowledge or approval.

Now, according to a letter from the board to owners obtained by The Dallas Morning News, it seems the owners have won the property war — but a battle over the board’s removal remains to be fought. The letter details the results of a survey sent by the board to owners on Aug. 24, in which owners were asked to choose between two options: supporting or opposing the board’s “Continued Efforts to Explore Potential Purchase.”

In the text of the survey, the board said it would “honor the collective decision of our community, and the certified results [would] be circulated.”On Wednesday, the board released the results, in which 206 of 282 respondents opposed the purchase. The number of respondents represented just under half of the complex’s 603 units...

Members are pressing the issue, even after the board’s surrender on the property purchase, because “we don’t trust them,” Lee said.“There’s a trust issue, lack of communication, arrogance, issues with not holding the management company accountable,” Head said.

FHOA: FYI some manager(s) out there seem to be convincing people that their status as "agent" (for service of process) is above the board, instead of subservient to it ... The board, being either clueless / lazy, invested in maintaining their business inside the HOA, and/or potentially receiving kickbacks, goes along with it ...

I'm sure you've heard plenty of news about lots of HOA out there, I've witnessed it at several, so I'm wondering how common this bamboozle is.

Does this sound familiar to any of you: Manager: "I'm an Agent of the HOA, and therefore insert ruse here."

Especially anything along the lines of obfuscating, denying or delaying access information by blocking meetings, elections, interfering with standard operations, etc. etc.

If there is any standardized training on managers as agents, please enlighten us regarding how this would normally be handled.

I am employed as a maintenance coordinator for a property management company. I knew very little about HOAs as I’m a owner of a single family home without an HOA. My job is to answer phone calls from homeowners from over 200 associations. Everything from selling a pool gate key to helping with getting roofs repaired and helping with interior damage repairs is how I spend my day. Most customers are reasonable and I sincerely do my best to help them. As homeowners you pay for amenities and you deserve them. It is a very entertaining job. The stories I could tell. I wish you all the best and would like to remind you that the property management company is just the middle man. It is your neighbors that are elected into their positions and their legal team that makes up the rules.

  • Another resident's unleashed German Shepherd almost attacked my dog.

Back in 2020, I applied for a rental permit in my small community and was placed on the waiting list. I would periodically check my status and was consistently told I was first on the list. Per our CCRs, there are only 4 rental permits available. Fast forward to 5 months ago, I found out that 3/4 permits were granted to a single person. As soon as I found out, I brought this to the board and explained how unfair it was for one person to have 3/4 permits in a very small community (less than 40 homes). They essentially told me there was nothing they could do since the prior board approved it and I would have to wait until a permit became available.

Recently, one of the tenants moved out of the rental owned by the person with 3 of the permits. I then checked Zillow and found out the landlord had the home listed for lease. Per our rules, the rental permit provides a “60 day right to lease” if you’re unable to rent your home in that time then it’s passed to the person on the waiting list. If there is no one on the waiting list, then the HOA will grant you another 60 day right to lease. Additionally, the home has been empty for the last month. Per our rules, as soon as the number of rentals drops below 4, the person on the waiting list has the right to the permit.

I reached out the board to let them that the unit had been listed for lease for more than 60 days and that due to only 3 homes currently being leased I was entitled to the permit. After almost two weeks (including me sending a follow up email) the president said he investigated and determined the current permit holder had a right to the permit. He basically ignored all the facts presented (including listing screen shots and me referencing the CCRs verbatim) and flat out said they would not grant me the permit.

At this point, the HOA is blatantly violating their own rules even when provided with evidence of the violation. Any thoughts on what to do next?

I was elected on my building board after the death on a member. Median age on the board was 80. I was 40 and the building manager was around 30. Beautiful art deco building full of very old owners; the older crowd wanted nothing to do with funding any repairs and pretty much ruled the board but each unit that sold was generally remodeled with younger owners (who mostly did not bother with board meeting) and there was tension. The elevator in my tier (from 1938) finally completely broke and was not easily fixable, giving me the option of walking up eight flights of stairs or using the service elevator and riding with the garbage trolley and everyone’s dogs and laundry. At the next board meeting I was so sick of hearing ‘fixed income’ from these people that had used the elevators (and everything else) for 40 years without ever setting money aside for eventual replacement…and one old lady (who still had a functioning passenger elevator in her tier) kept interrupting to tell us we should just be happy to use the service elevator and to understand that residents couldn’t afford any extra money. The building literally didn’t have the funds to address the issue and a 7 figure special assessment was needed. The next week the property manager (who was also just over it all) sent out a notice that the other passenger elevator had broken and repairs were not able to be made…and that we would all be using the service elevator. She included the schedule the custodian had for garbage removal and a note that dogs would no longer be allowed on the elevator between 7:30-10 am and 4:30-7 pm. It was a mass chaos with one creepy old service elevator for 90 apartments and people having to ride with the giant garbage can. After maybe a week or two, the service elevator (which had been modernized to not be from the 30s but still dated to 1970) stopped working. This really was an issue, leaving some people effectively stranded in their apartments. Another memo went out, letting people know that repairs would take several days and that garbage pickup was suspended…asking residents to carry their own garbage down with them. An emergency board meeting was called and a few hours before that meeting the main pressure pump for the water failed, leaving people above the 5th floor with just dribbles of water and the inability to flush the toilets. The entire thing was just a sh**show and as the majority of the building met in the lobby I was queasy, wondering what the hell was about to be decided. The building manager, to her credit, had her boss and her bosses boss there along with an attorney, letting the building know that emergency funding had to be approved or they were going to cancel the management contracts and that the board was in violation of our state condo laws. One lady named Evelyn was the board president and lived on the third floor…and voiced her opinion that we had to let people with limited means take priority over building needs. I thought she was going to be murdered right there. We managed to halfway fix the elevator and the experience forced the new owners to get involved with the his board and elections and attend meetings.

Context: I live in FL. This doesn't personally effect me but it does others.

My HOA under state law cannot deny someone solar panels if a homeowner wants them. They can't even deny where to put them; I have seen a couple that have them installed facing the front, not the back. This was after a FL couple sued because the HOA demanded them be installed in the back of the home and every solar company said they would useless there (Was obviously a tactic to discourage them from being installed).

My HOA also has free yearly roof pressure cleaning because the city I live in is a PITA when it comes to dirty roofs. Recently, the HOA sent us a letter saying that if you installed solar panels they will not be doing the free yearly roof cleaning on your house, if you want it done hire your own company and pay for it yourself.

Is this them just being petty due to not being able to deny solar installs or is it due to so much distrust in the company they hired to do the pressure cleaning that they are afraid of liability?

My HOA in San Diego loves to nitpick & look for the most minuscule non issues to post violations against home owners; I have already caught the board president & property manager walking the complex through neighbors front yards and pointing, pulling and prodding various exteriors of our units at random.

I recently got a violation for my electrical panel not being the same color as the stucco of my unit. Mind you, the electrical panel is my responsibility and no where in our CCRs does it state compliance of the color of the panel (standard silver) to match the stucco, however I obliged and painted. Now the board and property management refuse to close the violation stating that my cable utility box is also not in compliance. The utility box existed on the property prior to my ownership and was serviced by the same internet provider when we set up our service. Now I am fully aware I do not own this box, nor does the HOA, so what juridisction do they have to keep my violation open pending my painting over the cable utility box to match the stucco? Does HOA have any authority to dictate how a 3rd party utility service needs to look?

It is also worth noting that over 50% units in my community use the same cable box and do not match the stucco, 5 within my block of 8 units. I have raised this as selective enforcement but HOA & property management have stated that they are not at discretion to tell me if anyone else has been written up for the same, but I find it unrealistic that 50% of the community have been written up. The same could be said of neighbors who have solar panels with the electrical panel not matching the stucco, of which there are several in the complex.

Any advice?

We bought in this rural HOA about 5 years ago. Only a few dozen houses and a dozen more vacant lots, about 2/3 don't live here it's a 2nd property for them. At the time, the realtor put us in touch with the supposedly HOA president. They emailed me what they said was their declarations. They had nothing questionable and everything looked good. We bought the house after reviewing them.

Several times since then, we've had supposedly valid owner votes on new versions. Again, none of the new versions were recorded as required by our state. No problems to anyone here about that! (And I didn't know any better, never been in HOA, how would I know about that?)

We're built a few rental houses, small cottages. Finished one about 3 years ago, another about a year ago. That's it we're done, that's all the land we could buy, 3 parcels total.

Then all of a sudden, I get word a bunch of the owners that have been here 20+ years basically hate us. Never wave. Stupid fuck face mean look when we drive by. Always complaining about amount of traffic on the private road. Come to find out they think we're in violation because they think the recorded documents are valid so no rentals are allowed. The documents we've received, and voted on, since the, have no rental restrictions.

Our HOA also has no regular meetings (board meetings are not announced or open to members, minutes not available), doesn't provide proper financials or reports of any kind, never has licensed and insured people doing maintenance. (No plans or funds to fix anything, everything is just band aide fixed when it's busted.) Never had insurance, or filed tax returns. Both the corporate address and registered agent as on the secretary of state are defunct, hold elections without proper notice, count completely anonymous ballots mailed, emailed, or called in, themselves.

Basically these stupid fucks just do whatever the fuck the want, and that's that. They've said and put in writing that our state laws don't apply to them. And upon asking when the board meetings were, they said the only opportunity for any owner to be involved or ask questions or see what is happening was to run for board and get elected. (Run for the board that wouldn't meet even when already did that and was a board member!!) The story goes on and on.

So the shit fucks doing all this stupid shit with the Declarations are shit fuck rude people. And the others who've been here the longest don't even know what they did. Wow this seems like fraud.

Before you say become a board member, already did that. Year 2 and year 4. First year I resigned because they didn't want to hold any meetings, not even among board members. 2nd time, after I suggested we use a licensed contractor for something, they had a sudden unscheduled vote to elect a new board.

Don't know what we could've done differently. We relied on our realtor and title company to inform us and never owned in an HOA before.

Everyone should do their due diligence when buying into an HOA, even attend a meeting, look at ALL their records, etc.. The only solution here is to sue. Already saving up.

Edit: it's a rural HOA and the only property is a private dirt road which they maintain, but culverts are crumbling and busted, road base is exposed, big ruts everywhere. They do repair it, mostly themselves but never any licensed contractors, and only the bare minimum no advanced planning or proper repairs. Would love to disband it, but then how would we maintain the road? I've heard the only way to do that is 100% agreement to add deed restrictions and a road maintenance agreement. Not sure these stupid fucks would pay up and it could be even worse if we didn't have any HOA.

I live in a condo in NJ, we pay $100 a month for our parking spot on property. Last week we where accuse of putting two cars in one spot, it wasn’t us! It was our neighbor , and after two years of living here the HOA is trying to have us “register” our car with them and the form asks for our insurance information. Am I legally required to provide this?

They are also stating only the car registered with them can park there, like wtf! We pay for it and should be able to let whoever we want use it!!

Our site condo association refuses to enforce the bylaws. One of the first homes built seven years ago still only has sod but zero landscaping, even though it’s clearly stated in the bylaws that sod AND landscaping are required to be installed within 6 months after construction is completed. Everyone else is compliant except that one home, and the board president says she won’t do anything about it because “they are nice people and personal friends.” Trash cans sit out in plain sight because she “doesn’t like that bylaw” that says keep ‘em hidden. There are homes delinquent on dues but “such nice people shouldn’t be bothered about that.” I could go on and on. Basically, if she doesn’t agree with a bylaw, it doesn’t get enforced. The association is small and she & her cronies on the board just won’t do their jobs. You can’t get on the board because they’ve got a chokehold on votes. Can’t afford to move…so what’s the answer?

The HOA where I own a rental property sent out a notice stating that all late payments will bear 5% interest per month. Under state law (NY), that’s criminal usury, I think, at least if the homeowner is an individual.

When a homeowner told the board president that the interest rate is criminal usury, the president responded, “I can’t answer that because I’m not a lawyer. Your lawyer can tell you what it is or isn’t.”

Has anyone seen a HOA charge a late fee that constitutes criminal usury? If so, did anyone fight back?

Long story short, neighbors in 19 home neighborhood with history of trespassing (stealing fruit, frequent herbicide on plants they didn't like, general verbal harassment etc) spent $50k SO FAR to sue homeowners over fence they erected to protect themselves. Bad news, Judge Brittanye Morris has a documented hi$tory with developers and believes that Texas law does not apply.
