I have a dog, and the HOA has imposed a rule that dogs are not allowed to be walked on the sidewalk or anywhere on the property, but are only allowed to be walked on the very narrow driveway where there are cars. It's caused near accidents for my dog and I, with the passing cars on the extremely narrow driveway which can scare my dog.
The HOA claims the community is "pet friendly" and allows both dogs and cats, and says so in the CC&Rs which I looked over before buying this home. This rule was created by the HOA shortly after I bought, and we owners never have been allowed to vote on this or any CC&Rs rule changes, as the board says they have the right to impose and enact any rule changes to the CC&Rs that they want whenever they want on a whim.
All other dog owners are scared of the authoritarian HOA and just comply with this, and the HOA has singled out me and other dog owners with bs complaints because we have dogs, even though dogs are allowed. This is the most dog unfriendly HOA I've lived in. The main reason why I chose this complex was because they claimed it was "pet friendly" and that dogs are allowed.
Oh and btw the HOA Board President has a dog, and he thinks he's above the rules, so he walks his dog on the sidewalks of the complex while all of us peasants can only walk our dogs on the driveway.
I have tried to fight the HOA on this, saying that it's dangerous to force us to walk our dogs on the narrow driveway with cars passing by, instead of being able to do the sensible safe thing and walk our dogs on the sidewalks. Their response? They claim that most of us dog owners are "irresponsible" with poop pick up so that's why we're forced to be second class citizens unable to walk our dogs anywhere on the complex except for the driveway just because we have dogs.
What recourse can I take when other residents are too chicken shit to face the HOA?
