We keep two puppies in our empty garage so they have space to run and make a mess. We also have my grandma living with us temporarily while her new house gets built and she’s allergic to dogs. We noticed it gets really hot and stuffy in there so we bought a plug-in AC unit, removed a glass panel from the garage door and put the exhaust there. I figured a $500 purchase is good enough to keep the dogs cool for the next few month.

A neighbor complained and HOA is demanding that we remove the exhaust. Wtf?? I have two puppies in there and I can’t bring them inside. I live in Houston where it gets really humid. The exhaust isn’t even noticeable since the garage doesn’t face the street.

Our other neighbor warned us that HOA can forcibly remove the exhaust if we don’t do anything about it. I’ll raise hell if they do because I don’t need insects going in the garage and biting my dogs. I’m not going to put my dog’s well-being on the line so now I have to get a separate external AC unit and spend probably $1000+.

My HOA asked for an address update, I sent it, and they never updated the address. They sent me a notice in the mail for overdue payments that I never received notice of. Apparently they increased the HOA fees AFTER the board agreed and posted the amount. They also NEVER MAILED ANYTHING OUT ABOUT THIS INCREASE?!

On top of that, they seemed to have my address perfectly fine when sending this payment notice, but not when they set the increase in place?

How is this okay?!

Many HOAs have curfews during the day for kids (school hours). Hypothetical situation. Let’s say a kid feels unwell, and tells the school that they won’t be going in that day. If later on they feel better, and decide to go for a walk, are they violating a curfew? It’s insanely dystopian that you can’t go for a walk in your own neighborhood.

I won a small claims case against the hoa for their acts that damaged my property, and acts of fraud and deceit as part of their unlawful scheme. How do i maximize the impact of them loosing in court, towards shaming the guilty board members, removing them in the next election or via recall, and getting a board that respects the law and owners? While avoiding libel.

Everyday we go to the playground at our HOA community center. My toddlers love it, and unfortunately when we arrived today the entire playground jungle gym, and swings were all removed. I asked the lady at the front desk what happened and if they would be replaced and she laughed at me and said “we’ll see it’s there’s budget for that”. I’m very upset. I had to pack up my two kids back in the car while they’re crying because their playground is gone 😞. Is there anything I can do here?? I would appreciate any advice!

The current representative spends her time complaining about the quality of construction in the neighborhood, constantly assessing everyone's property for 'issues' and then gossiping about the 'issues' she finds.

Do you live in the fishbowl? Below is what the current HOA representative calls the 'Fishbowl' and the Fishbowl dwellers:

We need a HOA representative who spends their time helping to make the neighborhood better rather than one who talks bad about the neighborhood and spreading racist gossip.

So we had a large gorilla brand playset gifted from a family member (who unfortunately passed away) to my sons. We built it in a spot where the previous owner had theirs but my new neighbor has mailed me a threatening letter stating that I’m not being respectful of all families and face penalty of fines if I don’t move it directly behind my house. For reference it’s still in my backyard but it’s to the side and within my gate. She was impersonating the HOA since they never sent this letter and was happy to work with me to have the board approve the set. My question is… other families have their playset off to the side of their yard as well but I feel like we are being targeted. My son has severe autism with motor delays and my family member bought this set because it has a lot of similar exercises that he does with his PT. Having this equipment avoids me from taking off from work and spending gas to go to PT 25 miles away. I know it’s not an absolute necessity like a wheelchair ramp but isnt there some legal ground especially if she keeps harassing us? Or if by any chance she gets the HOA to change their mind? The fact that other families are not being harassed by this is deeply unsettling and I want to make sure my son is not being targeted for being and acting different from other children around here

The area has 98 homes. Average square footage is 5500. It could be argued that a hefty assessment is affordable if it’s $1.6 million for the project divided equally by 98 properties. They promise to reduce my bill by $250,000 in 20 years? I’ll be dead by then so not a compelling argument.

Yes, prices continue to rise with LADWP but is going rogue the best option?

Concerns about assessment are secondary, potential savings tertiary, and primary focus is what happens when this goes South? When they install a bad meter, I don’t have the same channels for grievances as I do at LADWP.

I’m not clear on the upside of an HOW water well without measurable findings from authenticated studies, but the down side of going rogue seem self-evident and many.

Does anyone have experience here? Questions I should ask at Sunday’s Board meeting? I’d appreciate whatever insight experience has taught you.

This scumbag sent a picture to the HOA of my barely visible "illegal" shed. Now I have 14 days to fire sell this thing or be fined. I'm thinking of getting a large clown face cutout to hang on my rear bay window that he has a clear view of. What else can I do to make this guy's view from his deck as unpleasant as possible?

3 months ago someone broke into my condo complex to steal mail. In the process they destroyed the mail boxes beyond repair and have to be replaced. We were told they would fix it as soon as possible, however 3 months later and counting, nothing has been done, nor have they updated us on the status of getting them replaced. We currently have to collect our mail at the postal sorting facility which is very inconvenient. It wasn’t bad to do for a few weeks, especially when we were told it would be fixed immediately, but here we are many many weeks later and there is no end in sight. Is there any sort of agency I can contact to report this? I just want to put the heat on them to get it done like yesterday. I’m tired of having to get in my car to go to get my mail, and as I’m sure everyone is aware, having to stand in line at the post office is never quick and easy.

TLDR; Destoryed mailboxes haven’t been fixed in over 3 months, what can I do about this?

So my house was built in the early 90’s, the original fence is still here, my neighbor built a new fence tied into mine crossing (at my estimate) between 6-16 feet onto my property.

I am currently waiting on surveyors to come mark the property line.

Assuming my suspicions are correct, I intend on telling my neighbor he need to remove where it is tied into my fence and build his fence on his property line.

My question is that according to the HOA double property line fences are not allowed, and fences must extend to the edge of your property.

Due to my fence being the original fence from the original developer, would my fence be essentially grandfathered in, or could they force me to rebuild my fence to the edge of my property line.

The big issue here is that the area in between our houses was prior to him cutting it all down a wall of green and now I have no property in my backyard and my second level master bedroom can be seen into from his backyard. And I want that space back and not fenced in by either of us as a natural wall.

So my intent is to kick him off my property, not move my fence and replant, or sue him to replace, all the greenery that was cut down.

I will be getting a lawyer for that part, but I mainly just wanted options on if my fence would be grandfathered in?

Every state is different, but stealing over $1k over any period of time with no statute of limitations is a felony in our state.

This means if a board nefariously misappropriates a total combined $1k over any course of time, it would seem to be collectively guilty of a felony.

Some places prosecutors are busy with other crimes. But many places have prosecutors salivating over throwing the book at any little thing they can. Time to start having meetings with prosecutors.

This HOA not only allows dynamite to blow up bedrock for development of homes which was approved ironically as soon as this new management came in. Palms are getting greased, and all resident have to just allow this non sense. Now, not only did they cut acres of forest but also displace all wild life and if that wasn't enough, they have been cutting down miles of 20 yr. Old Oak trees, leaving no shade for people who enjoy walking to publix and even those that don't drive, as many former city folks dont drive and walk up to the plaza. It's like we are getting punished all around by this HOA and their management company. Let them all eat cake is their attitude. All meeting are zoom and they hand pick a few questions leaving out the important things.

HOA passes a rule (not bylaw or CC&R) now making access to external utility outlets in side a trespass offense. Previously separate upstairs downstairs units shared thè utility outlets for water (and electricity and phone) even though they were on the downstairs units outside wall since the complex was constructed over 50 years ago. The area is now called “exclusive use common area” and upstairs units are facing a harassment rule interfering with their ability to access utilities on what is actually the “servient estate “ in all this-the downstairs unit.

Given no previous authority exists for trespass violations in the governing documents and trespass is a misdemeanor not infraction, can HOAs legally enforce a trespass charge?

We have an HOA board, actually just one guy on the HOA board who makes all the decisions, who has decided that it is ok that about half the units in the HOA that can not get fiber based broadband due to a recently discovered construction defect, and they do not actually need fiber based broadband. He basically is adamant that no HOA money be spent to fix the construction defects. He has a history of being obsessively let’s say frugal. He has decided, on his own, that other lesser broadband options are good enough for those owners. He made this decision without asking all of the affected owners how they feel about it. He thinks cellular based wireless options are good enough for them, that they won’t know the difference. Right now these affected units only option is Comcast.

My question is, would I have to disclose that fact to the new potential owner of my unit, that my unit won’t ever be able to get real fiber broadband as long as the current HOA board is in power? Maybe never.

I live in a condo neighborhood in Texas that was zoned with fire lanes on both side of road and no guest parking in the entire neighborhood. If guests come over, they must park in driveways which typically only accommodate 1-2 vehicles. The streets are not particularly narrow so no one understands why it was zoned this way. People are constantly parking on top of the fire lanes and the HOA sporadically issues fines.

I recently had our home inspected and the inspector told me that legally the HOA has no ground to stand on when issuing fines since they have not provided any viable guest parking options. Is there any truth to this?

A FL HOA has successfully argued that they are a voluntary social club and can terminate property rights at will, but doesn't that also mean that they cannot compel membership and thus dues? In my limited legal understanding, I think they just eliminated their legal tie to the land. The same HOA is also appealing another judgement against them from when they illegally assessed members for a capital improvement that they called maintenance, the court ruled that the protesting homeowners only had to pay for maintenance/operations, so now they just call the entire budget operations.

So the HOA has been resealing the roads recently in our community. Normally for the section they're resealing they close only one side of the road so traffic can get through. They do this both on the main road and the side streets where the houses are. Our HOA is setup so there's a main road in that goes from the front to the back gate. The houses are on all the side streets which are all circles so they meet the main road twice.

Today I got home and pulled down my street and a quarter of the waydown they've blocked both sides of the street. I went back out to the main road and down the other side of our street to find that again both sides of the road are closed about a quarter of the way down. Essentially preventing emergency access from getting to approximately 20-30 homes.

This can't be legal right? I tried calling non-emergency to the sheriff and they said since it's inside the community then it's private property and they can do whatever they want.

What's the play here?

I posted this in HOA but probably should have started here. I was on the board of the HOA and then uncovered that it was not an HOA at all. The officers had inherited a long-running potluck club and turned it into a regime. I uncovered the deceit, confronted them and told them they should get legal advice on moving forward in a an appropriate way. They added the word "voluntary" to the dues notices and reminders they send out. The president resigned quietly, I believe on quiet advice from an attorney, and is now the treasurer (haha). The "officers" refuse to acknowledge they ever called themselves an HOA but still act like one. The board is confused and doesn't really understand what happened. I quit.

Dues are really low, a few hundred dollars a year so who is really complaining?

Meanwhile, there was a large "common area" that was ignored by them for many years which I had always been pushing the board to spend some time or money on. I realized it was actually a city park and told the new president I was going to start a beautification project and didn't want any trouble. They said it wouldn't be a problem and even had faux outrage that I thought they might somehow be

I started working with the neighbors, the Parks Department and other local groups, yada yada, THe HOA got angry, ripping out some plants. took the areas we had prepared and ambush planted some shrubs there to prevent us working. One of the board members told me the officers are launching a bad mouthing campaign of blaming me for the past neglect (?) and roadblocking our plans by "planting over our work". I am frustrated.

When I was one the board, I had been asked to be a part of a merchant association as a community volunteer. I had also been floating the idea to the other 5 or 6 neighborhood associations in the area that they should try to all organize get together and maybe have future joint projects. The president of the HOA became furious and told everyone that I was "impersonating a member of their HOA". I backed out and moved on to other things.

I do not know how to handle this. It is like playing wack a mole where the officers find anything I am doing. take it personally and crush it. I am always trying to put out these gossiping defamation fires. Am I the a$$H@&*???

Thank you for letting me vent. I feel so sad that we could make the neighborhood so much better and instead just have drama. Really overthinking this and especially don't feel good about giving up on the park but hard to move forward.

Here's my question- maybe everyone can help me figure out a list of things someone should check to be sure it's a real and functioning HOA? Do potential buyers have access to meeting minutes, HOA records, etc, can the seller request and provide those? How can a buyer verify things are on the up and up, I thought a realtor and title company was supposed to do that, but apparently not.

Backstory: Our HOA is fucked. When we bought, almost 10 years ago now, realtor gave me contact info for the board president who emailed me what they said was CCR's. Then over the years owners voted on an even newer version of CCR's. Come to find out many years later, none of the new CCR's were ever filed with the courts as required. But never knew it was required. A much older, original version of CCR's from the 1980's is the only thing ever recorded. Thing is, I would've never bought based on what is recorded. But my realtor and everyone when buying said it was all good. There's more to the story: 2/3 of our owners are absentee and live out of state. So we never have enough participation, and the fuckers who've controlled everything since it was built still maintain tight control. No meetings, no proper records, no nothing, except bills each year.

EDIT: I reversed the order of paragraphs above, because I am NOT asking what to do with our situation. I'm looking for what a realtor, title company, or attorney is supposed to be checking to be sure everything is on the up and up.

I used to have a great relationship with my neighbor (5 years). Pleasant but nothing beyond “hello, have a nice day”. Sheʼs on the board of the HOA (condo).

I was an idiot and left my door unlocked yesterday. Well, she literally burst in. Like, just opened my door and came inside. I heard it and my dogs barking and come around the corner and sheʼs just standing there in my living room. The storm door was shut and the regular door was open. The storm door could easily be pushed open by my dogs.

There was no emergency, just some report of a missing/stolen car or something. No reason to burst into my place. She has my phone number.

I freaked out and screamed at her to get the fuck out and never do it again. Iʼm just worried about retaliation because sheʼs on the board.

But seriously, I feel like she is lucky I didnʼt call the police. Who feels entitled to do that? I mean, fucking board members, I guess.
